Acceptance The Use Of Aus-E-parts Terms and Conditions
Your  access  to  and  use  of  Aus-E-parts is  subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using  the  Website  you  are  fully  accepting  the  terms,  conditions  and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.
 
Advice
The contents of Aus-E-parts website do not constitute advice and should not be relied upon in making or refraining from making, any decision.
 
Change of Use
Aus-E-parts reserves the right to change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that Aus-e-Parts shall not be liable to you for any such change or removal and to change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

The Website is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
To the extent permitted by law, Aus-E-parts will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.
Aus-E-parts makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Aus-E-parts for death or personal injury as a result of the negligence of Aus-E-parts or that of its employees or agents.
 
Indemnity
You agree to indemnify and hold Aus-E-parts and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Aus-E-parts arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.
 
Severance
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the law of Australia and you hereby submit to the exclusive jurisdiction of the Australian courts.
 
Shipping and Delivery
Aus-E-Parts does not take responsibility for any goods shipped via Courier or Auspost that are lost or damaged in transit. This is at the buyers risk. Aus-E-Parts will do whatever they can reasonably to assist in tracing, tracking or recovering goods that are lost or damaged in transit. Aus-E-Parts also does not assume any responsibility if the purchaser when checking out incorrect inputs their goods shipping address or if the purchaser requests a change of address after checking out. Aus-E-Parts will do their best to assist the purchaser if the shipping address is changed or incorrectly specified.
 
Warranty and Returns
Aus-E-parts will refund you for items returned within 7 days of you receiving them, for any reason. A full refund excluding postage costs will be given if items are returned in their original condition.
 Merchandise which is damaged or missing components is not refundable.
 Buyers are responsible for return shipping costs with proper packaging.
 On receiving items, we will refund you immediately.

We provide 1 month replacement and 12 months maintenance warranties. Items can be replaced during the first month or maintained for the first year.

Buyers are responsible for the return shipping fees for warranty items. (In most cases, buyer will only have to return the problem components rather than the entire package.). 

Before returning items, please make sure you get our return address, and write “gift” on the delivery detail sheet.
Please use regular postal service and send us the tracking number. As soon as we receive the items, we will repair or exchange them ASAP.

For warranty items Auseparts will be responsible to pay the return to the buyer shipping costs for defective hardware items only. 
The customer/buyer will be responsible for payment of shipping costs on returned items where installed software has been either damaged or corrupted or overwritten. Auseparts will reinstall software for free where possible. Auseparts will make every effort to re-install original software where possible but does not accept any responsibility for returning reinstalled software items with the original versions or setup.

This warranty does not apply:
(i) to consumable parts, such as batteries, unless damage has occurred due to a defect in materials or workmanship;
(ii) to cosmetic item damage, including but not limited to scratches, dents and broken plastic on ports;
(iii) defects or damage caused by misuse, accident (including without limitation collision, fire and the spillage of food or liquid), neglect, abuse, alteration, unusual stress, modification, improper or unauthorized repair, incorrect installation, voltage stress or overload, incorrect wiring, or testing, improper storage, use in an unapproved device or if the serial number has been removed;
(iv) to damage caused by operating the product outside the permitted or intended uses.
